Workers' Compensation FAQ's
Lawyers in Chicago, Illinois

Accidents can happen to us at anytime especially in the workplace. The Illinois Workers' Compensation Act protects workers' who are injured in the course and scope of their employment. If you are hurt on the job there are several things you should know:

Q: What are my rights, if my injury prevents me from working?

A: If your physician orders you to stop or take time off work as a result of your injury, your employer is responsible for paying you two-thirds of your average weekly wage for the period of time you are restricted from work. This payment is called Temporary Total Disability (TTD). If the TTD period lasts more than three working days, weekly TTD compensation shall be paid beginning on the fourth day of such temporary total incapacity and shall continue as long as the temporary total incapacity lasts. In cases where TTD continues for a period of 14 days or more from the day of the accident, the TTD compensation shall commence on the day after the accident. In order to receive TTD benefits, your physician should prepare a written note ordering you off of work, which you must provide to your employer. Your employer is not required to provide you with TTD benefits unless an off work slip is prepared by your physician and presented to your employer.
