Q: Am I required to file a workers' compensation claim within a certain time limit?

A: When you suffer an injury while in the course and scope of your employment in Illinois, an Application for Adjustment of Claim should be filed with the Illinois Workers' Compensation Commission within 3 years of the date of the accident or 2 years following the last payment of compensation made to you for a work related injury, whichever period is longer. An Application for Adjustment of Claim is a formalized written statement establishing the factual basis for your workers' compensation claim. Failure to file the Application for Adjustment of Claim within the appropriate time period can result in benefits being permanently barred.
