Illinois House Bill 2531, passed in 2005, requires that all employees who may come into contact with residents at a nursing home must pass a criminal background check. Prior to this law, only employees who had direct contact with residents were required to have a background check preformed.
Under HB 2531, any employee who may have access to a resident’s living quarters, financial records, medical or personal records, or even pass a resident in the hallway must have a criminal record free of felonies, violent crimes, and financial infractions.
Despite this law, many nursing homes fail to adequately check the criminal records of their employees. This has led to an increase in nursing home abuse and neglect, leaving thousands of Chicago’s seniors at a higher risk for sustaining both physical and emotional injury.
