When your loved one moved into the facility, he or she should have received a copy of their rights. Every resident has certain rights that are guaranteed under state and federal law. These rights help promote self-determination and dignity.

Nursing home residents have dozens of rights, and as a family member, you should be aware of them. Read on to learn about what your loved one is guaranteed as a nursing home resident.

Dignity

Your loved one has several rights under this category. They have the right to be treated with respect and consideration. They have the right to be free from neglect, abuse and exploitation of themselves and their property. They also have the right to receive quality care and improved quality of life. At a nursing home, they should be able to use their possessions in a home-like environment.

Self-Determination

A person has the right to choose their activities, schedules and doctors. They have the right to request or refuse treatment. They can participate in resident groups and choose a representative to exercise their rights.

Information

A person has the right to be fully informed of the medical care they are receiving. They have the right to know about any changes, as well as any rules or regulations. They are required to receive written notice of any change in room or roommate.

Financial Affairs

A person has the right to manage their own finances. If they cannot do so, they have the right to know about different services available and their costs. A nursing home resident has the right to not be charged for services covered by Medicare or Medicaid.

Access

A nursing home resident has the right to allow or refuse visitors at any time. They have access to people, activities and services inside and outside of the facility. They have the right to access medical and personal records. They can also participate in social and community activities of their choosing. Their access rights include assistance for sensory impairments.
