On or about July 9, 2009, it was revealed that cemetery workers at Burr Oak Cemetery in Chicago dug up at least 300 graves and moved the bodies to different locations. This alleged action was done in order to resell the plots for a profit. This reprehensible activity was part of a pattern of conduct that went on for several years.
In order to seek redress for the Defendants’ shocking conduct, the law firm of Harvey Walner & Associates, Ltd. filed a Class Action lawsuit on July 24, 2009, in the US District Court for the Northern District of Illinois under Case No. 09 CV 4464. The representative plaintiff is Deborah Charles, daughter of Ezzard Charles, the world heavy weight boxing champion in the late 1940s. The lawsuit was filed for the benefit of the heirs to the decedent who have suffered unnecessary, emotional grief and trauma caused by the Defendants. You can view a copy of the complaint here.
Currently, the owners of Burr Oak, Perpetua, Inc. have filed for bankruptcy under Case Numbers 09-34022, 09-34030, and 09-34033. This means that the above lawsuit filed has been stayed pending the outcome of the bankruptcy case.
The Burr Oak Creditor’s Committee was formed and appointed by the United States Trustee to represent the interests of all unsecured creditors, including all our clients, in a Chapter 11 bankruptcy case.
