Five people suffered injuries and two people died when a tree branch from a 100-year-old tree came crashing to the ground at an Illinois firework show. Just minutes after the show started, the tree on the courthouse law fell to the ground. The branch was 45-feet in length and was over eight feet around at the base.

According to the Sheriff’s Department, a 61-year-old man was pronounced dead at the scene and a 72-year-old man died at the hospital. A woman who was pregnant was among those injured and gave birth to a healthy baby girl at the hospital.

What is a Premises Liability?

In some situations where there is an accident and injuries are suffered by visitors on another business or person’s property, the owner may be liable for those injuries under the theory of premises liability. To be sure, if you or your loved one has sustained injuries on someone else’s property, you may be eligible for compensation. An Illinois personal injury attorney will be able to evaluate your case and determine if you have a case.

How to Pursue a Premises Liability Claim

To pursue a claim against the owner of a property for injuries, you must prove that the owner of the property was negligent. To establish premises liability, the following must be proven:

  • The property owner owed you a legal duty. Did you legally visit the property or were you an invited guest?
  • The actions of the owner caused a breach of duty. Did the owner fail to fix a dangerous condition in a timely manner, or at least warn you about it?
  • That breach of duty resulted in injuries you suffered on their property. Did the breach cause injuries to you or your loved one?

Types of Premises Liability Claims:

Premises liability claims can arise in many different situations. Some of the most common include, but are not limited to, the following:

  • Slip and fall accidents
  • Falling objects
  • Contamination
  • Elevator and escalator accidents
  • Negligent security
