Recently lost a loved one? You have our deepest sympathies. If you believe your loved one died due to negligence of someone else, you could have the case for a wrongful death suit. If this is the case, you deserve compensation for the untimely loss of your loved one. Here at Walner Law® and Associates, we specialize in wrongful death suits and can advise you on the best way to take action.

While wrongful death can happen in many circumstances, there are some common causes that you may find to be similar to your case:

Motor Vehicle Accidents

If your loved one died in a car or truck accident, there may be a case for wrongful death. Motorists are supposed to operate their vehicles with a certain level of safety and conscientiousness. If you believe the motorists involved were driving with negligence and without any regard for others’ safety, you can file a suit. Disobeying traffic laws and disregarding road conditions, traffic, or construction are all examples of driving negligently.

Medical Malpractice

Doctors, nurses, and other healthcare practitioners are supposed to give a certain standard of medical care – if that level is not met and it results in an untimely death – that is grounds for a medical malpractice lawsuit. Unfortunately, this is an extremely common cause of wrongful death. In fact, it is reported that nearly one in five medical malpractice lawsuits concern a medical professional whose actions were fatal. It’s not just the healthcare practitioners who can be sued in a wrongful death claim – hospitals can be at fault, too.

Product Liability

When someone dies as a result of using a product, the manufacturers, distributors, and retailers can all be found negligent. Careless design, flawed manufacturing, or harmful ingredients can all attributed to a consumer’s death and thus, a wrongful death lawsuit.

Workplace Accidents

When you think workplace accidents, you probably associate these with manual labor jobs. Of course, this is where workplace accidents commonly occur, however, wrongful death can even happen in the safest of offices. Falls, equipment malfunction, electrical glitches, disregard by employers or supervisors – there are copious ways for a company to be found negligent of its employees. An employee has the right to come to work in a safe environment and if that safety is compromised, a wrongful death suit may be the next step.
